The Federal Environmental rules require the thorugh
researching and documenting of burials before
roadwork is performed. It is part of the
Environmental impact review process. Here in NY we
went around some Revolutionary War Burials
discoverd/overlooked before construction began. When
the issue arose it was easier to redesign the
project than to remove the burials.
Laws in various states vary as to how the burials
are handled. I have ancestors who owned the land
where West Point MIlitary academy stands. They were
buried alomg with many Revolutionary and early
settlers all over the property. When this particular
plot was acquired in 1888 the family burials.
location I haven'f found yet were moved to the West
Point Cem. which was actually the Town Cem.
originally. They now have a place of honor next to
US Grants son and Gen. Winnfield Scott among others.
