I Fremont Cole of the town of Edwards, do hereby make and publish this
my Last Will and Testament. First it
is my will that all my just debts and funeral expenses be paid and that
a suitable headstone by placed at my grave. Second, I give and devise unto
my friends Mary Wilson and Margaret Wilson of Edwards, NY the rest residue
of my personal estate after paying the aforesaid expenses and indebtedness,
to have and to hold the same and to share and share alike. Third, I hereby
constitute and appoint, Henry Rushton of Edwards, executor of this my last
Will and Testament. Fourth, I hereby revoke and annul any will or wills
hereuntofore, executed by me. In witness whereof I have hereunto set my
hand this 5th day of April 1881
Fremont Cole L.S. Witnesses: Cornelius Carter residing at Edwards, NY and
Robert Wilson residing at Edwards,
NY. Subscribed by Fremont Cole the testator named in foregoing will in
our presence and at the time of making such subscription declared by the
testator to be his last will and testament and each of us subscribes his
name as a witness at the end of the will at the request of the testator
and in his presence Cornelius Carter of Edwards, NY Robert Wilson of Edwards,
NY Probated at Surrogate's Court, St. Lawrence Co on the 10th day of July
A.D. 1882, Henry Rushton, executor named in the Last Will and Testament
of Fremont Cole late of Edwards in the County of St. Lawrence applied to
the Surrogate of the County of St. Lawrence to have the said Last Will
and Testament relates to both real and personal estate proved and recorded
and on such application the said Surrogate did ascertain by satisfactory
evidence who were the heirs at law and next of kin of said deceased testator
and their respective residences: Mary Cole (minor)of Edwards, NY, James
Cole of Dysart, ? Co., Iowa, Jay Cole (minor) of Seneca Falls, NY requiring
them to appear before the said Surrogate at his office in the village of
Gouverneur in said county on the 11th day of September A.D. 1882 and afterwards
to wit on the 11th day of September A.D. 1882 at Gouverneur satisfactory
evidence having been presented to the Surrogate of the service of the said
citation in the mode prescribed by law on said heirs at law and next of
kin and James McFerran (?) of Gouverneur was duly appointed and personally
appeared as the special guardian of said minors.
