Surrogate's Court, St. Lawrence County. Probate of the Last Will and Testament of Samuel W. Havens late of Macomb, deceased.

Be it remembered, that heretofore, to wit: on the 17th day of May 1907, Silas Clark Lawyer Executor named in the Last Will and Testament, of Samuel W. Havens, late of Macomb in the County of St. Lawrence, deceased, applied to the Surrogate of the County of St. Lawrence to have the said last Will and Testament which relates to both real and personal estate, proved and recorded; and upon such application the said Surrogate did ascertain by satisfactory evidence, who were the heirs at law and next of kin of said deceased testator, and their respective residences, viz: Charles N Havens of Oswegatchie, NY; Emma A. Lawyer; Elmer F Havens; Carrie A Harvey; Bessie M Petrie of Macomb, NY; Martha E McNeil; Frank M Petrie of DePeyster, NY; Sarah F. Harder of Ogdensburg, NY; Augustus R. Havens of 75 Pine Street, Burlington, VT. and said Surrogate did thereupon issue a citation in due form of law, directed to the heirs at law and next of kin by their respective names, stating their plac!
es of residence requiring them to appear before said Surrogate at his office in the city of Ogdensburg in said County, on the 8th day of July 1907 to attend the probate of said Will and afterwards to wit: on the 8th day of July 1907 at Ogdensburg aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of said citation in the mode prescribed by law on all said above named persons and John C Tulloch Esq., having been appointed special guardian for Bessie M Petrie and Frank M. Petrie, infants, and objections having been filed and said matter adjourned from time to time until September 10th, 1907 at which time such objections were withdrawn, no one appearing to oppose the probate of said Will , the said Surrogate took the proofs of said Will herein set forth and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient , and that the said Will and the proofs thereof be recorded; wh!
ich said Last Will and Testament and the proofs taken thereon are as follows, that is to say

In the name of God, Amen:
I, Samuel W. Havens, of Macomb, St. Lawrence County, New York, being of sound mind and memory, and considering the uncertainty of this life, do therefore, make, ordain, publish and declare this to be my last Will and Testament, that is to say:
First. After all my lawful debts are paid and discharged, I give and bequeath to my grand-children, Betsey M. Petrie and Frank Petrie, the sum of One Hundred Dollars each.

Second. I give and devise to my son Charles N. Havens, my wood lot in the town of DePeyster, St. Lawrence County, New York, to have and to hold the same to him, his heirs and assigns forever.

Third. I give, devise and bequeath to my daughter Emma A. Lawyer, wife of Silas Clark Lawyer, all the rest, residue and remainder of my estate real and personal, of whatsoever name or nature and wheresoever situate, to have and to hold the said real estate to her, her heirs and assigns forever; and the said personal estate to her absolutely.

Likewise, I make, constitute and appoint my son-in-law, Silas Clark Lawyer and my friend Robert E. Waterman, to be executors of this, my last Will and Testament; hereby revoking all former wills by me made.

In Witness Whereof, I have hereunto subscribed my name and affixed my seal, the eighteenth day of October, in the year one thousand nine hundred and six.

The above instrument consisting of one sheet was at the date thereof, subscribed by Samuel W. Havens the testator, named in the foregoing Will in the presence of us and each of us, and at the time of making the subscription, the above instrument was declared by the said testator to be his last Will and Testament; and each of us at the request of said testator and in his presence and in the presence of each other, sign our names as witnesses thereto, at the end of the Will
